1. Agreement
These Terms of Service ("Terms") govern your access to and use of the CasaFlow platform, including all related services, features, and functionality ("Services"). By creating an account or using the platform, you agree to be bound by these Terms and our Privacy Policy.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify CasaFlow immediately of any unauthorized use of your account.
3. Messaging Services
CasaFlow provides SMS, MMS, and voice communication services as part of the platform. By using these messaging features, you agree to the following:
- Consent requirements: You will only send messages to individuals who have provided prior express consent to receive them, in compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable federal, state, and local laws.
- Consent records: You are responsible for obtaining, documenting, and retaining records of consent for each recipient. CasaFlow may request proof of consent at any time.
- Opt-out handling: You will honor all opt-out requests immediately. When a recipient replies STOP (or any standard opt-out keyword), they must be removed from all future messaging campaigns. CasaFlow automatically processes opt-out requests on your behalf.
- Message content: You are solely responsible for the content of messages sent through CasaFlow. Messages must not contain prohibited content including but not limited to: illegal substances, hate speech, deceptive or misleading content, phishing, or content that violates carrier policies.
- Message frequency: You will clearly disclose the expected message frequency to recipients at the time of opt-in and will not exceed the stated frequency without additional consent.
- Identification: All messages must clearly identify the sending business. You must include your business name and a way for recipients to opt out in every message.
- Carrier compliance: You agree to comply with all carrier policies, industry guidelines (CTIA), and A2P 10DLC registration requirements. CasaFlow reserves the right to suspend messaging capabilities for non-compliance.
4. Prohibited Messaging Uses
You may not use CasaFlow messaging services to:
- Send unsolicited messages (spam) or messages to purchased contact lists.
- Send messages without proper consent or to individuals who have opted out.
- Engage in phishing, fraud, or any deceptive communication practices.
- Send content related to illegal substances (including cannabis in jurisdictions where it remains federally prohibited), firearms, gambling, or adult content unless explicitly permitted by carrier guidelines.
- Share, sell, or distribute phone numbers or consent data to third parties.
- Use shared or pooled short codes for messaging campaigns.
- Circumvent opt-out requests, carrier filtering, or any messaging regulations.
- Impersonate another business, organization, or individual.
5. AI-Powered Voice Agent
CasaFlow provides AI-powered voice agents that can handle inbound and outbound phone calls on behalf of your business. By using this feature, you agree to the following:
- AI disclosure: You are responsible for ensuring that callers are informed they may be interacting with an AI voice agent where required by applicable law. CasaFlow provides configurable disclosure settings, but compliance with local regulations is your responsibility.
- Call recording consent: Calls handled by the AI voice agent may be recorded and transcribed. You are responsible for complying with all applicable call recording consent laws in your jurisdiction, including one-party and two-party consent requirements. You must configure appropriate disclosures for your callers.
- Accuracy disclaimer: AI-generated responses are based on your configured business settings and knowledge base. While we strive for accuracy, AI responses may occasionally contain errors, inaccuracies, or incomplete information. CasaFlow is not liable for actions taken based on AI-generated responses.
- Prohibited AI uses: You may not use the AI voice agent to impersonate a specific real person, deceive callers about the nature of the interaction where disclosure is legally required, or conduct any unlawful activity.
- Voice data: Voice interaction data is processed by a third-party AI provider to deliver real-time voice agent functionality. This data is handled in accordance with our Privacy Policy.
6. Billing and Payments
Paid features are billed according to your selected plan and any add-ons. Fees may include third-party provider costs (e.g., carrier surcharges, per-message fees, AI usage fees) where applicable. All fees are non-refundable except as required by law or as expressly stated in your plan terms. CasaFlow reserves the right to update pricing with 30 days' notice.
Payment processing is handled by a third-party payment processor. By providing payment information, you agree to the payment processor's terms of service. CasaFlow does not store full credit card numbers or bank account details on our servers. You are responsible for keeping your payment information current and ensuring sufficient funds for recurring charges.
7. Acceptable Use
You agree not to use CasaFlow for any unlawful purpose or in any way that violates these Terms. In addition to the messaging-specific restrictions above, you agree not to:
- Interfere with or disrupt the platform or servers connected to CasaFlow.
- Attempt to gain unauthorized access to any part of the platform.
- Use the platform to harass, abuse, or harm others.
- Violate any applicable laws, regulations, or third-party rights.
8. Suspension and Termination
CasaFlow may suspend or terminate your account and messaging capabilities immediately if:
- You violate these Terms or any applicable laws or regulations.
- Your messaging practices result in carrier complaints, high opt-out rates, or violations of carrier policies.
- You fail to maintain valid A2P 10DLC registration where required.
- Continued use of your account poses a risk to CasaFlow, its users, or third parties.
You may terminate your account at any time by contacting CasaFlow support. Upon termination, your right to use the platform ceases immediately.
9. Intellectual Property
CasaFlow and its original content, features, and functionality are owned by CasaFlow and are protected by applicable intellectual property laws. You retain ownership of any content you submit through the platform.
10. Disclaimer and Liability
CasaFlow is provided on an "as is" and "as available" basis to the maximum extent permitted by law. CasaFlow makes no warranties, express or implied, regarding the platform's availability, reliability, or fitness for a particular purpose.
CasaFlow is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. CasaFlow is not responsible for message delivery failures caused by carrier filtering, network issues, or recipient device limitations.
11. Indemnification
You agree to indemnify and hold CasaFlow harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these Terms, or your messaging practices, including any failure to obtain proper consent or comply with applicable messaging laws and regulations.
12. Changes to Terms
We may update these Terms from time to time. We will notify account holders of material changes via email or through the platform at least 30 days before changes take effect. Continued use of CasaFlow after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
